Welcome to the official membership streaming platform owned and operated by Guitarist James Tomaskovics LLC (“Company,” “we,” “us,” or “our”). These Terms of Service and Conditions (“Terms”) legally govern your access to and use of our website, streaming services, music services, internet radio, guitar training (collectively, the “Services”). By creating an account, purchasing a membership, or accessing our content, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Account Eligibility and Security

- Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase a streaming membership.
- Account Security: You must provide accurate, complete information during registration. You are solely responsible for safeguarding your password and account activity.
- No Account Sharing: Memberships are strictly individual. You may not share your login credentials, password, or account access with any third party.

2. Membership Plans, Billing, and Cancellations

- Subscription Fees: Access to premium guitar streaming content requires an active, paid membership. Pricing and features for each membership tier are specified clearly at checkout.
- Automatic Renewal: Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless canceled before your next scheduled renewal date.
- Payment Processing: All payments are handled securely through our authorized third-party processors. You authorize us to charge your selected payment method for recurring membership fees.
- Cancellation Policy: You can cancel your membership at any time via your account settings page. Cancellation stops future automated billing, and you will retain access until the end of your paid billing period.
- Strict Refund Policy: Due to the immediate digital delivery of our streaming video libraries, guitar tabs, and educational content, all membership sales are final. We do not issue partial or full refunds for remaining time in a billing cycle.

3. Intellectual Property Rights

- Ownership: All videos, instructional content, audio tracks, performances, sheet music, guitar tabs, text, graphics, and logos hosted on the platform are the exclusive property of Guitarist James Tomaskovics LLC and are protected by international copyright laws.
- Limited Educational License: Your membership grants you a limited, non-exclusive, non-transferable, revocable license to stream and view content for personal, educational, and non-commercial use only.
- Prohibited Actions: You are strictly prohibited from ripping, downloading, recording, copying, redistributing, broadcasting, selling, or using any video or tab content for commercial purposes without explicit, written consent from Guitarist James Tomaskovics LLC.

4. Community Rules and Conduct

If your membership grants you access to interactive features like comments, discussion forums, or live chat streams, you agree to behave respectfully. You may not post or share anything that is:

- Illegal, defamatory, threatening, abusive, or harassing.
- Infringing upon third-party copyrights, intellectual property, or privacy.
- Commercial advertising, spam, or promotional links.

We reserve the absolute right to remove user-generated posts and terminate accounts that violate this code of conduct without issuing a refund.

5. Disclaimer of Warranties

- “As-Is” Service: The Services are provided on an “as-is” and “as-available” basis without any warranties, express or implied.
- No Progression Guarantees: Educational content and tutorials are meant strictly for instructional purposes. Guitarist James Tomaskovics LLC does not guarantee specific skill advancement, technical mastery, or career outcomes.
- Technical Outages: We do not guarantee that the video streaming service will be 100% uninterrupted, completely secure, or error-free at all times.

6. Limitation of Liability

To the maximum extent permitted by law, Guitarist James Tomaskovics LLC and its representatives shall not be held liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the platform’s streaming services.

7. Account Termination

We reserve the right to suspend or entirely terminate your account and platform access at our sole discretion, without prior notice, if we determine you have breached any part of these Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the where Guitarist James Tomaskovics LLC operates.

For United States Residents: These Terms and any disputes arising from your use of the Services shall be governed by and construed in accordance with the laws of the State of LLC registration (or, where applicable, the state laws of (Ohio and New Jersey), without regard to conflict of law principles. You agree to submit to the exclusive personal jurisdiction of the state and federal courts located within those respective jurisdictions to resolve any legal matter.
For Jerusalem, Israel: If you access the Services from from Jerusalem, Israel, you agree that these terms remain governed by Israeli Jewish Law (Halakha) any disputes that cannot be settled amicably will be resolved through binding arbitration or the designated courts of Israel.

We may update these Terms from time to time. We will alert you to major modifications by updating the “Last Updated” date at the top of this document. Your continued use of the platform after an update implies full acceptance of the new Terms.
