Welcome to the terms and conditions (“Terms”) for Guitarist James Tomaskovics LLC. These Terms are between you and Guitarist James Tomaskovics LLC (“Guitarist James Tomaskovics LLC” or “Us” or “Guitarist James Tomas”) and govern our respective rights and obligations. Please note that your use of the guitaristjamestomas.com website and the Guitarist James Tomas Membership/Subscription are also governed by this agreement as well as all other applicable terms, conditions, limitations, and requirements on the guitaristjamestomas.com website, all of which (as changed over time) are incorporated into these Terms. If you sign up for the Guitarist James Tomas Membership/Subscription, you ARE accepting these terms, conditions, limitations and requirements.
Membership Cancellation
You may cancel your Guitarist James Tomas Membership/Subscription any time by visiting your account and adjusting your Membership/Subscription settings. We cannot offer refunds if you cancel your Guitarist James Tomas Membership/Subscription before your next payment is due. If you lost internet access or access to your account you may call us at 1-800-597-0194 to cancel you Membership/Subscription.
Fees and Renewal
From time to time, we may offer different Guitarist James Tomas Membership/Subscription terms, and the fees for such James Tomas Membership/Subscription may vary. The Guitarist James Tomas Membership/Subscription fee is nonrefundable. Taxes may apply.
If all eligible payment methods we have on file for you are declined for payment of your Guitarist James Tomas Membership/Subscription fee, you must provide us a new eligible payment method promptly or your Guitarist James Tomas Membership/Subscription will be canceled. If you provide us with a new eligible payment method and are successfully charged, your new Guitarist James Tomas Membership/Subscription period will be based on the original renewal date and not the date of the successful charge.
YOU UNDERSTAND YOUR GUITARIST JAMES TOMAS MEMBERSHIP/SUBSCRIPTION WILL
AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US TO COLLECT THE THEN APPLICABLE GUITARIST JAMES TOMAS MEMBERSHIP/SUBSCRIPTION FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.
Termination By Us
We may terminate your Guitarist James Tomas Membership/Subscription at our discretion without notice.
Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST GUITARIST JAMES TOMAS MEMBERSHIP/SUBSCRIPTION FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR GUITARIST JAMES TOMAS MEMBERSHIP/SUBSCRIPTION.
Limitation on Claims
In the event of any claim, dispute, or controversy arising out of or relating to these Terms of Service & Conditions, or the use of our services, products or websites you agree that any claim or cause of action seeking damages or relief in excess of $3,000 USD is expressly waived, and you may not initiate or pursue any such claim in any court or other forum.
